Privacy Notice

1. Scope

Caymanensis Environmental Consulting (“Caymanensis”) respects your privacy and takes care in protecting your personal data. As a data controller, we comply with the Cayman Islands Data Protection Act (2021 Revision) (the “Cayman Islands DPA” or “DPA”). This privacy notice (“Privacy Notice”) demonstrates our commitment to ensuring your personal data is handled responsibly.

2. What data we collect

Caymanensis collects personal data, including sensitive personal data, directly from you and may also collect your personal data indirectly from third-party sources. Personal data collected by Caymanensis is limited to what is necessary for our processing activities. In this Privacy Notice, personal data includes any data relating to an identified or identifiable living individual and may include: contact details, physical and mailing addresses and property owner ownership details.

Personal data we collect directly from you
Caymanensis collects the following information directly from you:

a. Personal data you provide through the Caymanensis website;

b. Personal data you provide when you contact us by email or telephone, or access our programmes and services, including our online services;

c. Images and/or expressions of personal opinion when you leave feedback, contact us, or approve its use;

d. Payment and/or bank data including credit or debit card details;

e. Any information you choose to provide when interacting with Caymanensis on social media platforms; and,

f. Personal data you provide in order for us to deliver our services and products.

User data may be collected about you as a user of our products and services. We may also collect data from other sources, such as social media platforms or applications that may share your device data/content and/or how you interact with our social media content.

Caymanensis collects data that you voluntarily provide to us, including when you communicate with us via email or other channels; when you sign up for or request that we send you informational materials; when you request a quote for services from us; when you sign up for an event; and when you respond to our communications or requests for data. The data you provide may include your name, contact data, title, and data about the organisation with which you are affiliated.

3. How we use your data

Caymanensis may use your personal data for the following purposes:

a. Providing services and managing your relationship with us;

b. Responding to your inquiries;

c. Verifying your identity;

d. Sending you marketing communications;

e. Communications and public relations activities;

f. Managing accounts payable and receivable and preventing fraud; and

g. Statistical and other reporting.

4. How we share your data

Caymanensis may share your personal data as required, with recipients that
include our data processors. We will only share your personal data as permitted by the Cayman Islands DPA.

Your personal data may be shared with the following recipients/data processors that support our operations:

a. Webhosting

b. Records/information management

c. Communications

d. Marketing and campaigns

e. Events management

f. Security operations/fraud prevention

g. Receiving payments for services provided

4. Our grounds for processing your data

Caymanensis relies on the following legal grounds to process your data:

Performance of a contract – We may need to collect and use your personal data to enter into a contract with you or to perform a contract that you have with us. 

Consent – We may use personal data as described in this Privacy Policy subject to your consent. To withdraw your consent, please contact us via email at caymanensis@gmail.com, or you may be able to disable settings, such as, the sharing of location data in your browser or mobile application settings.

5. How we keep your data safe

To the extent we are able, Caymanensis has put in place appropriate measures to protect your data. However, we cannot guarantee the absolute security of your data and we are not responsible for the security of data you transmit to us over networks that we do not control, including the internet and wireless networks.

6. How long we keep your data

Caymanensis may store your personal data for as long as we need it in order to fulfil the purpose(s) for which we collected your personal data. Sometimes, we may anonymise your personal data so that it is no longer associated with you.

7. How we respect your rights

Caymanensis will respect and honour your rights in relation to your personal data and implement measures that allow you to exercise your rights under the DPA and other applicable legislation.

a. The right to be informed and the right of access – The right to request access to all personal data Caymanensis maintains about you as well as supplementary information about why and how we are processing your personal data. This is commonly known as a Data Subject Access Request and certain supplementary information about our processing is contained within this Privacy Notice.

b. Rights in relation to inaccurate data – The right to request the rectification, blocking, erasure or destruction of any inaccurate personal data Caymanensis maintains on you. We will ensure, through all reasonable measures, that your personal data is accurate, complete and, where necessary, up‑to‑date, especially if it is to be used in a decision-making process.

c. The right to stop or restrict Processing – The right to restrict or stop how Caymanensis uses your personal data in certain circumstances.

d. The right to stop direct marketing – The right to stop direct marketing, whatever the medium. Any electronic marketing communications we send you also contain opt-out mechanisms that allow you to opt-out from receiving those communications at any time. Caymanensis will honour your choice and refrain from sending you such announcements. You may also opt back in to receive those communications at any time.

e. The right to complain – The right to complain to the Ombudsman about any perceived violation of the DPA.

f. The right to seek compensation – The right to seek compensation in the Court if you suffer damage due to a contravention of the DPA by Caymanensis.

8. Data protection principles

When processing your personal data, Caymanensis will comply with the eight Data Protection Principles defined within the DPA.

9. Changes to this notice

Caymanensis reserves the right to update this Privacy Notice at any time and will publish a new Privacy Notice when we make any substantial updates. From time to time, Caymanensis may also notify you about the processing of your personal data in other ways, including by email or through our publications.
